These Terms of Service ("Terms") govern the provision of digital marketing, media buying, and artificial intelligence (AI) integration services by True Infinity ("Agency", "we", "us", "our") to our clients ("Client", "you"). By accessing our website or engaging our services, you agree to these Terms.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value.
Nothing in these Terms limits, excludes, or modifies the statutory consumer guarantees provided under the ACL.
True Infinity provides specialized media strategy on third-party platforms (Google Ads, Microsoft Ads, Meta) and implements custom AI solutions.
All intellectual property rights in templates, ad structures, custom scripts, prompts, and internal operational AI code designed by True Infinity remain the property of True Infinity, unless explicitly transferred via a Statement of Work. Upon full payment of service fees, clients receive a non-exclusive license to utilize generated assets for their direct business operations.
All invoices issued by True Infinity are denominated in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST), unless otherwise indicated. Payments must be cleared within 14 days of invoice issuance. Late payments may attract interest in accordance with the Penalty Interest Rates Act 1983 (Vic) or applicable state legislation.
These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of New South Wales, Australia.
Each party irrevocably agrees that the courts of New South Wales shall have exclusive jurisdiction to settle any dispute or claim.
If any provision of these Terms is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted.
